Privacy Policy
Simpletrail ("we"/"us") takes your privacy seriously. We run a curated catalog of indie puzzle games through our Website as a place to discover games focused on spatial reasoning and observation. This Privacy Policy explains how we collect, store, use and share your information through the Website and related services (together called the "Services"). Our Terms of Service govern how you use the Services, so you should read those too. You can find Simpletrail's Terms of Service at Simpletrail.
CONSENT
By using the Services you agree to how we collect, use and share your Personal Information as laid out in this Privacy Policy. You always have the choice whether to provide Personal Information or not. Two kinds of information can be collected through the Services: Personal Information and Non-Personal Information. This Privacy Policy doesn't cover information that privacy laws don't currently restrict: (a) publicly available information like names, addresses, phone numbers and email addresses listed in directories; or (b) Non-Personal Information (defined below). "Personal Information" means information that identifies you, such as your name and email address. We may keep this to provide the Services and communicate with you. "Non-Personal Information" is anonymous information like your Internet Protocol Address (IP Address) and data our web servers automatically collect through your browser or cookies when you visit the Website. We also collect aggregate information like how many users visit and where they're located. This Privacy Policy focuses on Personal Information, but we're explaining Non-Personal Information too so you understand how the Services work.
TYPES OF INFORMATION COLLECTED
Registration & Forums: You need to create an account and pick a username to use the Services. Your username is visible to everyone who accesses the Services. The forums and discussion areas let you talk with other community members. Information you share publicly can be collected and used by people you don't know. Don't share Personal Information in public areas, and sharing other people's Personal Information goes against our Terms of Service. IP Addresses. Your web browser sends your IP address when you visit a page on the Website. We record this with your account information in our databases. We use it to: Diagnose problems and issues users report that relate to specific IP addresses. See how many users visit from different regions and use the Services. Track down the source of any malicious or illegal use of the Services (like multiple accounts) so we can disable it quickly. Simpletrail Applications on Partner-Operated Websites: Using the Services on third-party websites (like social platforms) may require you to 1. be registered on that partner site, and 2. install a Simpletrail application on your partner account. If the app needs to be installed on a third-party website, you usually have to agree to that site's Terms of Service. Device IDs: When you download or install our applications, we get information like a unique device identifier. We use this to sync your account to your device. The device identifier doesn't include or give access to your name, address or other personal details registered to that device. Support: If you email us or contact us another way, we may keep those communications to handle your inquiries, answer your requests and improve our Services. User Feedback: We may collect ratings and reviews from users. You're responsible for reading and following the third-party providers' rating policies. Use: We use your Personal Information to provide the Services, resolve disputes, fix problems, analyze how the Services are used, improve our content and offerings, catch and stop errors and fraud, send you system or admin messages, and anything else we tell you about at the time we collect it. These uses make the Services better and more tailored to what you need, giving you a safe, smooth and personal experience.
DISCLOSURES & TRANSFERS
We have safeguards in place to protect your Personal Information at a high level. We won't disclose, transfer or sell your Personal Information to third parties without your permission, except as explained in this Privacy Policy (see Important Exceptions below).
IMPORTANT EXCEPTIONS
We can disclose your Personal Information to third parties without your consent if we believe it's necessary to identify, contact or take legal action against someone who may be hurting or interfering with our rights or property, other Website members, other users of the Services, or anyone else (including their rights or property) who could be harmed. We may disclose Personal Information when we reasonably believe the law requires it. Nothing in this Privacy Policy limits any legal defenses or objections you may have to a third party's or government's request for your Personal Information. We may also disclose your Personal Information if we reorganize, merge with another entity, sell all or most of our assets or stock, or conduct due diligence related to any of these, as long as the information continues to be used for purposes this Privacy Policy allows. We use subsidiaries, affiliates and third-party providers (together, "Third Parties") to help provide the Services and host data off-site. We may share your Personal Information with Third Parties as part of using their services. We pick Third Parties we think are reputable and capable of doing what we need, including handling confidential and Personal Information and following all applicable laws.
THIRD PARTY SITES & ADVERTISERS
Our Services use third-party tracking, data collection and analytics tools from providers like Game Analytics, Facebook, Admob and Singular. These third parties use cookies, APIs and SDKs in our Services to collect and analyze user and device data on our behalf. They may collect information about you such as your device identifier, MAC address, IMEI, locale, geo-location, IP address, app usage, session times, what apps are on your device and how you interact with ads. They do this to provide their services, like deliver advertising. When you use the Services you may encounter various third-party vendors and websites. We don't share Personal Information with these vendors or websites and we don't control their privacy policies. Any information you give to a third party or any cookies they use are governed by that website's privacy policy. If you have questions about providing Personal Information on another site, contact that site directly and read their Privacy Policy. Ads on the Simpletrail website and in the Services come from us or third-party web advertisers. When you click an ad you may go to another service where we don't monitor or control privacy. Third-party advertisers may set cookies so their ad server recognizes your computer when they show you ads. Ad servers may track where you viewed their ads and which ones you clicked. This Privacy Policy doesn't cover third-party ad cookies and you should check their privacy policies.
SECURITY
Your Personal Information's security matters to us. We take technical, contractual, administrative and physical steps to protect it. We limit who on staff can access your Personal Information to only those who need it. Internet transmission isn't completely secure though. We do our best to protect your Personal Information but can't guarantee it's safe when sent through the Services. Any transmission is at your own risk. We're not responsible if someone gets around our privacy settings or security measures. You also need to help protect your information. Never share your passwords, real name or address. Don't use your real name as your username. Log out of your account and close your browser when you're done using the Website or Services.
RETENTION
We keep Personal Information only as long as needed for the reason we collected it, or as the law requires, which may be after our relationship ends. We may keep certain data to prevent fraud, stop future abuse or for legitimate business reasons like analyzing aggregated non-personal data, account recovery and legal compliance. Any Personal Information we keep stays under this Privacy Policy.
ACCESSING AND DELETING PERSONAL INFORMATION
Right to erasure (right to be forgotten) – You have the right to review, update, correct or delete any Personal Information in your account and request account closure. To ask for access to, review, verify, correct or delete your Personal Information, submit an in-game support ticket or email our support team at contact@simpletrail.space. We may decline if the change would break a law or make the information wrong. We may ask for specific information to confirm your identity and that you have the right to access, and to give you the Personal Information we have or make your changes. The law may let or require us to refuse access to some or all of your Personal Information, or we may have destroyed, erased or made it anonymous under our record retention practices. If we can't give you access we'll explain why, subject to legal or regulatory limits. We'll provide access to your Personal Information except for things privacy laws let us keep, such as: Information protected by lawyer-client confidentiality. Information that's part of a formal dispute. Information about another person that would reveal their Personal Information or confidential business details. Information that costs too much to provide. For deletion requests we'll take reasonable steps to remove your personal information from our records. But certain records about payments or customer service stay for legal and accounting reasons. We may also keep information to exercise, defend or establish our rights. Withdrawing Your Consent
If you gave consent to how we collect, use, transfer or sell your Personal Information, you may have the legal right to withdraw it in certain cases or object to how we process, transfer or sell it. To withdraw consent, contact us at contact@simpletrail.space. Keep in mind that withdrawing consent may mean we can't give you a particular product or service. We'll explain what happens so you can decide.
TRANSFERRING YOUR PERSONAL INFORMATION
We may process, store and transfer your Personal Information to foreign countries with different privacy laws that may not be as strong as Canadian law. In these cases governments, courts, law enforcement or regulators in that country may be able to access your Personal Information under their laws. When we use a service provider, including cloud providers, we require their privacy and security standards to match this Privacy Policy and Canadian privacy laws. Contact us if you want to know more about our policies on service providers outside Canada. By using the Site or providing your Personal Information you agree to this transfer, storage or processing.
OUR POLICY REGARDING CHILDREN
If you're under 13 you need parental consent before using the Services. We won't knowingly contact or engage with children under 13 without parental consent. We encourage parents and guardians to watch and review how their child uses the Services. If you think a child gave us their Personal Information or you're worried about how we collect, use or share it, or you want us to stop collecting or delete your child's information, email contact@simpletrail.space and we'll try to delete it and address your concerns.
AMENDMENT OF THIS POLICY
We can change this Privacy Policy anytime. If we make changes we'll post a notice on the Simpletrail home page. Small changes like clarifications take effect when posted. Big changes take effect 30 days after posting on the Website. Unless we say otherwise our current Privacy Policy applies to all Personal Information. The update date is at the bottom of this document. If you keep using the Services you're accepting any changes.
